1. Acceptance of Terms

By accessing or using ifPNG ("the Service") you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is provided by Free Content ifPNG ("Free Content ifPNG", "we", "us", "our"). You can reach us at legal [at] ifpng.com.

2. Description of the Service

ifPNG is a web-based image conversion and compression tool that allows users to convert images to and from formats including PNG, WebP, JPG, and AVIF. The Service provides both free and premium tiers. Image processing occurs on our servers, and converted files are delivered to your browser for download.

3. Accounts and Authentication

Some features of the Service require you to create an account. You may register using an email address and password, or via a third-party authentication provider (Google, GitHub). You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Permitted Use

Subject to these Terms, you are granted a non-exclusive, non-transferable, revocable licence to use the Service for lawful purposes. Permitted uses include:

• Personal and commercial image conversion and compression.
• Batch processing of images for web projects, applications, and design workflows.
• Educational and testing purposes.

5. Prohibited Use

You agree not to:

• Upload content that is illegal, harmful, harassing, defamatory, or that infringes on third-party intellectual property rights.
• Use the Service to process images containing child exploitation material or other content prohibited by law.
• Attempt to reverse engineer, decompile, or extract the source code of the Service beyond what is made available under its open-source licence (if applicable).
• Automate access to the Service in a manner that places an unreasonable load on our infrastructure (beyond the rate limits provided by your plan).
• Resell access to the Service as a standalone product without our written permission.
• Circumvent or attempt to circumvent usage limits, authentication, or payment requirements.

6. Subscriptions and Payments

Premium features are available through paid subscription plans processed by Paddle (Paddle.com Market Ltd), which acts as our Merchant of Record. By subscribing, you agree to:

• Paddle's Terms of Service for payment processing.
• Recurring billing at the selected interval (monthly or annual) until cancelled.
• Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date.

7. Intellectual Property

The code, design, user interface, documentation, and any original content of ifPNG are the intellectual property of Free Content ifPNG or are made available under an open-source licence. No rights are granted to you in respect of that property other than as necessary to use the Service as described in these Terms.

You retain full ownership of the images you upload and the converted files you download. We claim no rights over your content.

8. No Warranty

The Service is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties including, but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• That the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
• That the image conversion output will be lossless or suitable for your specific use case.
• That the quality, colour accuracy, or metadata of converted images will meet specific standards.

9. Limitation of Liability

To the fullest extent permitted by law, Free Content ifPNG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of or inability to use the Service, whether based in contract, tort (including negligence), statute, or otherwise, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability is limited to the greatest extent permitted by law. Our total aggregate liability shall not exceed the amount you have paid us in the 12 months preceding the claim, or €100 (one hundred euros), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Free Content ifPNG and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your violation of these Terms;
• Your infringement of any third-party intellectual property rights through the content you upload;
• Any content you produce using the Service that violates applicable law.

11. Links to Third-Party Sites

The Service may contain links to third-party websites or services. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

12. Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms at any time. Material changes will be reflected in the "Last updated" date. Your continued use of the Service after any change constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent Italian courts, unless mandatory consumer protection law in your country of residence provides otherwise.

If you are a consumer in the EU, you also have the right to use the EU Online Dispute Resolution platform to resolve disputes.
